Terms & Conditions

1.	These terms and conditions are presented to you by us, Smartvisit Solutions Australia (ABN 46 096 253 093) of Suite 303, 272 Pacific Hwy Crows Nest NSW 2065.
2.	You must read these terms and conditions carefully before accepting possession of the Adelaide Attractions Pass (Pass), the Adelaide Attractions Directory (Directory) and any related material.
3.	By purchasing or accepting possession of the Pass or the Directory you agree to be bound by these terms and conditions.
4.	You agree that use of the Pass and nothing in these terms and conditions constitutes a relationship of partnership, agency, trust or fiduciaries between us and us.
5.	The Pass gives you the opportunity to receive certain benefits when you shop at certain shops, visit certain attractions or dine at certain restaurants (collectively Merchants). The decision to take advantage of these opportunities is strictly at your discretion and any unused benefits at the time of expiry of the Pass will not be refundable or transferable to another Pass.
6.	The Pass expires twelve months from the date of purchase and is only valid for the number of consecutive days as stated on the Pass.
7.	The Pass is not refundable and no replacements or refunds are offered for lost or stolen Passes and the Pass is not valid for any same day return visit to any Merchant.
8.	The Directory merely provides information relating to certain Merchants and the benefits that may be offered by them to holders of a valid Pass. We have taken best endeavours to ensure that the benefits noted in the Directory are current at the date of publication of the Directory, but however, such benefits may be varied at the discretion of the Merchants. We take no responsibility for the conduct, quality, availability or any other thing related to the benefits available from the use of the Pass. Before relying on any information provided, such as opening times of the attractions, you should confirm their authenticity by contacting the Merchant.
9.	Use of the Pass and the Directory is at your own risk. To the extent permitted by law, we make no warranties about the accuracy and completeness of any material in the Directory or that the Pass or the benefits offered by the Pass will attain any particular service standards, be free of defects or be fit for any particular use. We limit our liability for warranties implied by statute or otherwise to resupplying the relevant services. To the extent permitted by law, we disclaim all liability arising out of or consequent to your use of the Pass or the Directory.
10.	You indemnify us against any loss or damage suffered by us or any third party as a result of your use of the Pass or the Directory or breach of any of these terms and conditions.
11.	All intellectual property rights used or embodied in or in connection with the Pass, Directory or related material is owned or licensed to us. You must not use, reproduce, distribute, modify, adapt or in any other way interfere with such intellectual property rights.
